These Terms of Use govern your use of the Privacy Guard browser extension and the GuardNivo website. By installing or using Privacy Guard, you agree to these terms. If you do not agree, do not install or use the extension.

1. About Privacy Guard

Privacy Guard is a browser extension that changes your browser’s default search provider to a search service operated through guardnivo.com. Search requests entered through the browser may be processed by GuardNivo and passed to a third-party search provider in order to return search results.

2. No guarantee of complete privacy

Privacy Guard is intended to support search awareness and provide access to search functionality. It does not make you anonymous, prevent all tracking, encrypt all browsing activity, block every unwanted suggestion or guarantee that searches will remain private. Your browser, search provider, internet provider and websites you visit may process information independently.

3. Permission to use the service

We grant you a limited, personal, non-exclusive, non-transferable and revocable right to use Privacy Guard for lawful personal use, subject to these terms and the applicable browser-store rules.

4. Your responsibilities

You are responsible for:

  • the searches you submit and websites you choose to visit;
  • checking that Privacy Guard is suitable for your needs;
  • maintaining the security of your device and browser; and
  • complying with applicable laws and third-party terms.

5. Prohibited use

You must not:

  • use the extension or website for unlawful, fraudulent or abusive purposes;
  • interfere with, overload, disrupt or attempt to gain unauthorised access to our systems;
  • introduce malware, automated attacks or harmful code;
  • copy, modify, resell, sublicense or distribute the extension except where applicable law expressly permits it;
  • reverse engineer or attempt to extract source code except to the extent such restriction is prohibited by law; or
  • misrepresent your relationship with GuardNivo or Privacy Guard.

6. Third-party services and search results

Privacy Guard may connect to third-party search providers and may display or redirect you to third-party websites. We do not control or endorse all search results, advertisements, websites, products or content supplied by third parties. Your use of those services is governed by their own terms and privacy policies.

7. Intellectual property

Privacy Guard, GuardNivo, the website design, branding, software and related materials are owned by us or our licensors and are protected by applicable intellectual-property laws. These terms do not transfer ownership of any intellectual property to you.

8. Updates and changes

We may update the extension or website to add, change or remove functionality, improve security, meet browser-store requirements or address technical issues. Updates may occur automatically through your browser. We may also change the default search service or supporting providers where reasonably necessary to operate the extension, subject to applicable disclosure and consent requirements.

9. Suspension and termination

We may suspend, restrict or discontinue all or part of Privacy Guard where reasonably necessary for security, maintenance, legal compliance, abuse prevention or business reasons. You may stop using the service at any time by uninstalling the extension or changing your browser’s default search provider.

10. Availability and warranties

Privacy Guard is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we do not make warranties that the service will always be available, uninterrupted, error-free, secure, suitable for every purpose or that every search result will be accurate or appropriate.

11. Limitation of liability

Nothing in these terms excludes or limits liability that cannot legally be excluded. Subject to that, GuardNivo will not be liable for indirect, incidental, special or consequential loss, loss of profits, revenue, data, opportunity or reputation arising from use of or inability to use Privacy Guard, third-party search results or linked websites.

12. Indemnity

To the extent permitted by law, you agree to be responsible for losses or claims arising from your unlawful misuse of the extension or a serious breach of these terms.

13. Privacy

Our handling of information is described in the Privacy Policy, which forms part of these terms.

14. Changes to these terms

We may update these terms from time to time. The latest version will be posted on this page with a revised “Last updated” date. Continued use after an update means you accept the revised terms, where permitted by law.

15. Governing law

These terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, except where mandatory consumer law in your country gives you the right to bring proceedings elsewhere.
